TO
CREATE A FRAMEWORK FOR THE REALTOR PROFESSION AND OTHER NECESSARY REGULATIONS


1 - Short Title and Enactment
(1) This Act may be cited as the ‘Real-Estate, Allocation, Licensing, Transfer, and Ownership Regulations’ (aka: R.E.A.L.T.O.R) Act.
(2) This Act may be numbered as P.B.01-XXX (To be assigned by the Office of the Speaker).
(3) This Act shall be enacted immediately upon its signing.
(4) This Act is authored by Member of Parliament Thritystone.
(5) This Act is co-sponsored by Member of Parliament Ibney.

2 - Reasons
(1) There are currently no laws guaranteeing the rights of property owners with regard to eminent domain and due process of law.
(2) There is sufficient public support for regulations involving inactive plot holders.
(3) The Realtor Profession currently lacks any tangible benefits or privileges of responsibility.
(4) There is currently a shortage of available property on the public markets.
(5) Private development of commercial and residential plots is generally in the interest of this Kingdom.
(6) There is a need to preserve the economic realism of labor and cost to the construction of all structures, whether they be public or private.



3 - Definitions

  1. “Player” is defined as any tourist, resident, citizen, or person legally engaged in the Kingdom of Alexandria forums, discord, or in-game.
  2. “In-game” is defined as activity on Minecraft, at play.mcstatecraft.com.
  3. “Play-time” is defined as the duration of a player’s presence within Minecraft at play.mcstatecraft.com.
  4. “Zoning” is defined as the classification of land according to “commercial”, “residential,” and other restrictions placed on its use and development, designating any particular plot for specific purposes.
  5. “Inheritor” shall mean a singular player or legal entity represented by a single player who a plot owner has designated to inherit property in the event of inactivity.
  6. “Realtor” shall mean a player holding a current license issued by the Ministry of Development under §4.
  7. “Eminent domain” shall mean the act of an official government entity removing ownership of a plot from a player for public re-sale, public use, and does not guarantee compensation to the original owner unless stipulated by this or other statues.
  8. “Property Lien” is a legal claim on assets that allows the holder to obtain access to the property if debts are not paid.
4 - Realtor Profession
(1) Players who are Realtors may own up to three (3) more residential or commercial plots than the standard player total.
  1. The plot limit for non-Realtors shall be five plots of any kind (e.g., C, R, RC, etc.).
  2. Realtors owning more than five plots must declare which properties are awaiting development or resale.
(2) Within 30 days of acquiring a surplus plot, the Realtor must either
  1. list it publicly for resale or
  2. file a Development Start Notice with MoD. Failure to do so authorizes the MoD to impose a £100 one-time fine and revoke the Realtor’s license.
  3. A Development Start Notice must contain a rough timeline and plans for development. Failure to complete a development on time authorizes the MoD to impose a £100 one-time fine on the Realtor.
  4. Repeated failures to complete developments on time shall result in the revocation of the Realtor’s license.
  5. As long as it has not lapsed, a Realtor may apply to extend their development timeline with the MoD.
    1. Extensions are subject to the approval of the MoD.
    2. Extensions may only be granted one per development.

5 - Property Rights Guarantee
(1) No player, with at least four hours of in-game play time over the last thirty (30) days, shall be deprived of property without the due process of law where it is required.
This includes, but is not limited to:
  1. the orders of a court; or
  2. other provisions of this and other acts of parliament.

(2) The Ministry of Development (MoD) shall be empowered under this Act to promulgate policies with regard to aesthetics, commercial requirements, and zoning standards.
  1. The MoD is empowered to promulgate an eminent domain policy for plot owners who have less than four hours of play time in the last thirty days.
  2. The Ministry of Development may not issue eminent domain removals as a penalty for zoning, aesthetic, or ministerial policy violations, provided that plot owners have at least four hours of gameplay within thirty days.
    1. The eminent domain removal policy must be published on the forums
  3. The Ministry of Development may fine a plot owner for regulatory violations no higher than £200 per plot per day.
    1. The Ministry of Development is empowered to promulgate and enforce policy rules and financial penalties.
    2. The Ministry of Development may place a property lien on any property with outstanding balances on fines or property taxes after reasonable effort to inform the property owners for fourteen days via Discord, in-game mail, and on the forums.
  4. A permanent record of all punitive measures shall be made and posted in the forums, which shall include all evidence.


(3) This act amends the Eminent Domain Act §4(1) to add:
“The Ministry of Development shall have the power to initiate eminent domain proceedings against the owner of any property within the Kingdom of Alexandria who has not attained four hours of in-game play time within the last thirty days. “

(4) Plots with a historical and unalterable feature may file for waivers from the Ministry of Development for special exemptions from property policy, including but not limited to, a plot’s height, shape, colour or other aesthetic features.
(5) Plot owners may register an inheritor for their plots either on the forums under an MoD thread or declare such with a clearly visible in-game sign, erected and locked by the plot owner on the plot in question, in the event that a plot is evicted for any reason.
  1. During eminent domain proceedings, an Inheritor, who has at least four hours of playtime in the last thirty days, may claim the inherited property after filing any relevant transfer tax and processing fees to the Ministry of Development.
    1. The Ministry of Development is empowered to set and collect an inheritance tax, as well as processing fees.
    2. The inheritor may only receive the inherited plot if this inheritance complies with the plot limit provisions of this and other acts.
    3. In lieu of receiving the plot, the inheritor may opt to receive the proceeds of an eminent domain auction, of which any relevant tax and processing fees are applied.
    4. It shall be the responsibility of the inheritor to meet all eligibility requirements and to notify the Ministry of Development during the eminent domain-to-auction period of their claim.
    5. In the event that there is no inheritor, the Ministry of Development shall conduct an eminent domain auction and pay the proceeds to the Treasury.

6 - Paste policy
(1) The Power to paste, use creative mode, or any other means of spawning in items, blocks, or materials for all public builds is solely reserved for the Ministry of Development.
  1. All pastes for Public or Government projects must be issued a public tender, which shall account for 100% of the materials used in the structure.
    1. Temporary structures for events that are set to be deleted within 30 days of the event are exempt from this provision.
(2) The Power to paste is solely reserved for designated Ministry of Development employees. Improper use of MoD pasting powers by an employee shall result in the build’s deletion, revocation of pasting permissions, and a £1000 fine.
  1. The Ministry of Development shall manage all administrative aspects of allowing private pastes, including charging a processing fee.
  2. The relevant minister shall set the administrative fee for MoD approval for private pastes. The minimum material tender requirement shall be 150% of the materials used.
  3. The Ministry of Development may promulgate any other rules or requirements for private pastes.
 
AMENDMENT 01
Should the associated Motion to Amend pass, the P.B. 01-032 shall be amended in the following manner:

(4) Plots with a historical and unalterable feature may file for waivers from the Ministry of Development for special exemptions from property policy, including but not limited to, a plot’s height, shape, colour or other aesthetic features.
(a) Buildings exceeding a 60-block build height shall pay a one-time building height tax of £1000 to the Ministry of Development within 30 days of being notified or by voluntary notification for a licence to build above 60 blocks, which shall not be transferable to other plots. No structure shall exceed 180 blocks above the street level.
(b) The Ministry of Development must accept a height limit extension, unless the plot is presently in violation of other non-height-related provisions of this and other acts of parliament or ministerial policy.
 
AMENDMENT 02
Should the associated Motion to Amend pass, the REALTOR Act shall be amended in the following manner:

"5 - Property Rights Guarantee
(1) No player, with at least four six hours of in-game play time over the last thirty (30) days, shall be deprived of property without the due process of law where it is required."
