Awaiting Assent P.B. 04-001 | Minister and Legislative Separation Act

Parliament notes:
(1) That the requirement of Ministers having to serve within Parliament creates an unnecessary constraint preventing competent people from holding the positions.

Based on this, Parliament decides:
(1) To abolish the requirement for a Minister to be Member of Parliament;
(2) To grant Ministers the right to be heard in Parliament.

To fulfil this, Parliament projects the following expenses:
(1) None.

Further, Parliament projects the following administrative efforts:
(1) Administering the possibility for Ministers to be heard.

To implement the above, Parliament passes:

1 - About this Act
(1) This Act
(a) may be cited as ‘Minister and Legislative Separation Act’ or ‘MLSA’.
(b) may be numbered as P.B.04-001.
(c) shall be enacted upon being publicly assented to.
(d) has been authored by Member of Parliament Rubilubi55.
(e) has been co-sponsored by Member of Parliament MrNeighbor.

2 - Amendments to the Constitution
Section 11 of the Constitution shall be amended in the following manner:

"A Minister is a Member of Parliament who is appointed by the Prime Minister, through a government proposal, to lead a specific government ministry portfolio. A Minister is responsible for implementing policies, managing public services, and making decisions within their delegated areas of responsibility. A Minister, on request to the Speaker of Parliament, has the right to speak in Parliament, subject to rules of decorum."

AMENDMENT 01
Should the associated Motion to Amend pass, §2 - Amendments to the Constitution of the Minister and Legislative Separation Act shall read:

"2 - Amendments to the Constitution
(1) Article 8 of the Constitution shall be amended in the following manner:

"8. Election of the Prime Minister
The Prime Minister is the party leader that Member of Parliament who commands the confidence of the Parliament to form a government. This can either occur through a ruling majority party in the Parliament or as a result of a coalition of parties to form a minority government.

In the proposal to form the Government, a Deputy Prime Minister, who will act as Prime Minister in the event of the Prime Minister’s absence, shall act in their capacity.
In the proposal to form the government, the Prime Minister shall select another Member of Parliament to be the Deputy Prime Minister. The Deputy Prime Minister assumes the powers and duties of the Prime Minister in the event of the Prime Minister's absence.

(2) Article 10 of the Constitution shall be amended in the following manner:

"10. Ministers
A Minister is a Member of Parliament who is appointed by the Prime Minister, through a government proposal, to lead a specific government ministry portfolio. A Minister is responsible for implementing policies, managing public services, and making decisions within their delegated areas of responsibility. A Minister, on request to the Speaker of Parliament, has the right to testify before Parliament regarding their portfolio.
