1 - Short Title and Enactment
(1) This Act may be cited as ‘Inactive Owner Act’ or ‘InactO-Act’.
(2) This Act may be numbered as P.B.01-### (to be assigned by the Office of the Speaker).
(3) This Act shall be enacted immediately upon its signage.
(4) This Act has been authored by ItsStormcraft and Member of Parliament Capt11543.
(5) This Act has been co-sponsored by Member of Parliament SeminoBlue.
2 - Reasons
(1) To counteract the current plot crisis, where many plots are unavailable and bring no value to the city due to being owned by inactive players.
(2) To directly empower the Ministry of Development to use the Eminent Domain process to expropriate plots which are owned by inactive players or remain undeveloped.
3 - Inactivity of the Owner
(1) If an owner shows under six hours (6hr) of playtime in the last thirty days (30d), they shall be given a notice by the Ministry of Development that their plot(s) will be expropriated in fourteen days (14d).
(2) If the notice is still unanswered after fourteen days (14d), their property may be expropriated without compensation.
(3) If the owner shows under six hours (6hr) of playtime in the last 30 days (30d) for a second consecutive month, their property may be expropriated without compensation or notice.
(a) The Ministry of Development shall include a notice about this provision with the notice required by §3(1).
4 - Lack of Development
(1) If an owner does not make efforts in developing their plot, they shall be given notice by the Ministry of Development that their plot(s) may be expropriated if undeveloped.
(a) The Ministry of Development shall require the plot owner to submit a plan to develop the property, or sell it.
(i) The Ministry shall review the submitted plan against all applicable laws and regulations. If the submitted plan is found to be deficient, the Ministry shall provide clear and complete reasoning supporting its finding and require the plot owner to submit a revised plan which addresses the deficiencies.
(ii) If no plan for development or sale is submitted within fourteen days (14d), or no revisions to a deficient plan are submitted within fourteen days (14d) of the Ministry's request for the same, the property may be expropriated under the terms of the Eminent Domain Act.
5 - Non-Compliance
(1) If a plot is found to be in violation of any applicable law or Ministry regulation, the plot owner shall be given notice by the Ministry of Development that their plot(s) may be expropriated if they remain out of compliance.
(a) The Ministry of Development shall require the plot owner to submit a plan to develop the property, or sell it.
(i) The Ministry shall review the submitted plan against all applicable laws and regulations. If the submitted plan is found to be deficient, the Ministry shall provide clear and complete reasoning supporting its finding and require the plot owner to submit a revised plan which addresses the deficiencies.
(ii) If no plan for development or sale is submitted within fourteen days (14d), or no revisions to a deficient plan are submitted within fourteen days (14d) of the same, the property may be expropriated under the terms of the Eminent Domain Act.
6 - Rights of Land Owners
(1) Except pursuant to §3 of this Act, plot owners shall enjoy the same rights set forth in §5 of the Eminent Domain Act with regards to property seizures executed under this Act.
(2) Except pursuant to §3 of this Act, the Ministry of Development is held to the same obligation set forth in §4(3) of the Eminent Domain Act with regards to the purchase price of plots expropriated pursuant to this Act.
(3) If a plot is to be expropriated, the owner may provide a reason for why they are currently inactive or not developing their plot. They shall state the time required to remedy these issues.
(a) If such reasoning is delivered before the Ministry is authorized to expropriate their property, and the time extension requested is reasonable, the plot shall not be expropriated during this time.
(b) If the time requested is longer than thirty days (30d), it shall be lowered to thirty days (30d).
7 - Plot Crises
(1) A motion may be filed in Parliament to declare a plot crisis.
(a) A crisis may at most be declared for fourteen days (14d).
(b) If the crisis is not resolved by then, it can be extended for up to seven days (7d).
(c) A crisis may be extended more than once.
(2) During a plot crisis, the Ministry of Development gains additional powers:
(a) Land may be expropriated pursuant to §3 (Inactivity of the Owner) of this Act when the owner has less than 90 minutes (1.5hr) of playtime in the last seven days (7d), in which case, notice shall be given that the plot will be expropriated in five days (5d), if no action is taken.
(b) Land may be expropriated pursuant to §4 (Lack of Development) or §5 (Non-Compliance) of this Act when the owner does not submit a plan or an amended plan within five days (5d).
(c) Time extensions granted under §6(3) of this Act now have a maximum of fourteen days (14d).
