1 - About this ActBILL

Reform the Criminal Code of the Kingdom of Alexandria
(1) This Act
(a) may be cited as the Criminal Code Act.
(b) may be numbered as P.B.##-###.
(c) shall be enacted upon its assent and the assent of the Criminal Procedure Act and the Statute of Limitations Terminology Modification Act.
(d) has been authored by SoggehToast.

2 - General Provisions (1) This Code constitutes the exclusive and exhaustive listing of all criminal offenses within the jurisdiction of the Kingdom of Alexandria for conduct occurring after its enactment. No person may be charged with a criminal offense unless that offense is contained within this Act, except where the conduct constituted an offense under the Criminal Code and Procedure Act at the time it occurred.
(2) Any new offense that seeks to impose a fine or imprisonment must be introduced as an amendment to this Act.
(3) For a criminal offense to occur, a player must have both a guilty mind and a guilty action. A guilty mind requires a showing that the player acted intentionally, knowingly, willfully, recklessly, or negligently. A guilty action requires showing that through their guilty mind, a player acted in a defined way to commit the criminal offense.
(4) A player may not be held criminally liable for conduct that substantially occurred during an event if that conduct was in furtherance of the goals or spirit of that event defined by staff or the Ministry of Internal Affairs.
3 - Definitions
(1) “Negligence” shall refer to causing a substantial risk and failing to perceive that risk as a gross deviation from the standard of care of a reasonable person.
(2) “Recklessness” shall refer to consciously disregarding a substantial and unjustified risk.
(3) “Knowingly” shall refer to acting with awareness of the nature of one’s conduct or the result of one’s conduct.
(4) “Intentionally” shall refer to acting with specific purpose or desire to cause a particular result.
(5) “Willfully” shall refer to acting with deliberate intent or volition.
(6) “Affirmative Defense” shall refer to any fact or set of facts, which, when introduced by the defendant, serves to excuse, justify, or otherwise mitigate the legal consequences of a charge.
(7) “Penalty Unit” means £100. Where this code specifies a fine in Penalty Units, the fine shall equal the number of penalty units multiplied by £100.
(8) “Privately Prosecutable” shall refer to a designation which indicates that an Indictable Offense may be initiated by the victim or their legal counsel, in addition to the Crown.
4 - Offense Type Definitions
(1) “Summary Offense” shall refer to an offense which may be dealt with by immediate penalty and without prior court approval. A defendant may appeal a Summary Offense conviction to the Magistrate Court.
(2) “Indictable Offense” shall refer to an offense which requires a judicial determination of guilt before punishment is imposed.
(3) “Parliamentary Offense” shall refer to an offense where Parliament retains the authority to adjudicate and impose punishment directly without a judicial trial, as prescribed by law.
(4) “Court Offense” shall refer to an offense where a judicial officer may adjudicate and impose punishment directly during proceedings without a separate trial, as prescribed by law.
5 - Affirmative Defenses
(1) The following affirmative defenses are available to a defendant. The burden of proof for an affirmative defense always rests with the defendant.
(a) Necessity is a justification where the player engages in conduct to prevent a greater harm to themselves or others, and the harm created was lesser than the harm prevented. Necessity may serve as an excuse and reduce punishment.
(b) Consent is a justification for a violent offense. Players may consensually fight each other and will not be held liable for injuries or deaths that result.
(c) Duress is an excuse where the player commits an offense because of a threat of force against themselves or another player. Duress shall not be a defense where the actor knew or should have known that it was likely they would face the threat, or was responsible for creating the circumstances that produced it.
(d) Self-Defense is a justification where:
(i) the player acts to protect themselves or another player;
(ii) they did not instigate the confrontation, or if they did, applied a lower level of force than the aggressor;
(iii) they had reason to believe that they or another player were in danger of gross bodily injury or death; and
(iv) the force used was reasonable and proportionate to the threat.
(e) Defense of Property is a justification where the player uses reasonable and proportionate force to prevent the unlawful taking, destruction, or interference with their property.
6 - Restitution
(1) A court may order restitution where a person suffers harm as a result of the offense. Where restitution is specified as a penalty of an offense in this Code, the court shall order restitution. In all other cases, the court may, at its discretion, order restitution for any offense where monetary loss or other compensable harm can be shown.
7 - Offenses Against the Person
(1) Murder - A player is guilty of murder if they intentionally and knowingly, or with extreme recklessness, kill another player without consent from that player.

(2) Manslaughter - A player is guilty of manslaughter if they unintentionally kill another player through reckless action.

(3) Attempted Murder - A player is guilty of attempted murder if they take a substantial step toward the intentional killing of another player, which fails to result in death.

(4) Mass Murder - A player is guilty of mass murder if they intentionally and unlawfully cause the death of four or more players in short succession.

(5) Assault - A player is guilty of assault if they intentionally threaten to cause bodily harm with clear, unconditional, and immediate ability to cause harm.

(6) Battery - A player is guilty of battery if they intentionally touch another individual in such a way that any reasonable player would believe was unwarranted and would cause discomfort.

(7) Threats - A player is guilty of threats if they communicate a declaration of intent to inflict harm, punishment, or loss on another person.

(8) Killing of a Mob - A player is guilty of killing a mob if they kill a mob owned by another player without permission from that player.

(9) Involuntary Servitude - A player is guilty of involuntary servitude if they coerce another player into performing labor or services against their will by threat, force, or other forms of coercion, and the player is compelled to perform the services as a result.

8 - Offenses Against Property and Commerce
(1) Theft - A player is guilty of theft if they take the property of another without the consent of the property owner and without force or threat of violence.

(2) Robbery - A player is guilty of robbery if they use force or threats of violence to take the property of another without the consent of the owner of the property.

(3) Destruction of Property - A player is guilty of destruction of property if they intentionally or through negligence and without the consent of another player destroy or deface that player’s property.

(4) Trespassing - A player is guilty of trespassing if they enter the property of another without their consent, or after obtaining consent enter or fail to leave the property of another after being asked to leave.

(5) Chest Locking - A player is guilty of chest locking if they intentionally lock a chest they do not own without the permission of the owner.

(6) Fraud - A player is guilty of fraud if they use deceit, falsehoods, or trickery to obtain something of value from another player.

(7) Embezzlement - A player is guilty of embezzlement if they illegally obtain another player’s property through deception while in a position of trust or fiduciary duty.

(8) Extortion - A player is guilty of extortion if they use information pertaining to the victim, or authority over the victim, to incite fear in the victim in order to force the victim to perform a task or service at risk of that information being used against the victim.

(9) Commercial Bribery - A player is guilty of commercial bribery if they offer, confer, or agree to confer any benefit upon an employee or agent without that employee’s employer's consent, in order to influence the conduct of that employee or agent in relation to the employer’s affairs.

(10) New Player Fraud - A player is guilty of new player fraud if they defraud another player, and their target was chosen based on that target’s actual or perceived lack of experience in Alexandria.

(11) Foreign Exchange Fraud - A player is guilty of foreign exchange fraud if they purchase Alexandrian Pounds for any other foreign currency, asset, or item of monetary value, for a price below its market rate, through misrepresentation, misdirection, fraudulent intent, or some other criminal intent as enumerated under law.

(12) Market Manipulation - A player is guilty of market manipulation if they knowingly take any action intended to artificially distort the price or trading volume of a security, company, or public asset, whether by inflating or deflating its value, for the purpose of personal gain.

(13) Insider Trading - A player is guilty of insider trading if they knowingly buy, sell, or otherwise trade in a stock or asset on the basis of material information not available to the public, where that information would be likely to influence a reasonable trader’s decisions, or if they knowingly disclose such information to another person for the purpose of enabling such a trade.

(14) Bid Rigging - A player is guilty of bid rigging if they knowingly enter into an agreement with one or more other players to coordinate, suppress, or manipulate the competitive bidding process for the purpose of predetermining its outcome.

(15) Price Fixing - A player is guilty of price fixing if they knowingly enter into an agreement with one or more other players to fix, maintain, or control the price of goods or services for the purpose of eliminating price competition.

(16) Market Allocation - A player is guilty of market allocation if they knowingly enter into an agreement with one or more other players to divide or apportion markets, customers, or products among themselves for the purpose of suppressing or eliminating competition.

(17) Monopolization - A player is guilty of monopolization if they acquire or maintain market power through exclusionary or anti-competitive conduct, rather than through legitimate competition.

(18) Corporate Espionage - A player is guilty of corporate espionage if they knowingly obtain non-public proprietary information through unauthorized means and disclose that information to a player who does not otherwise have lawful access to that information.

9 - Proper Administration of Justice
(1) Perjury - A player is guilty of perjury if, while under oath or affirmation in any judicial proceeding or Parliamentary hearing, they intentionally lie or falsify information.

(c) Maximum Penalty: 150 Penalty Units fine + 20 minutes in jail
(2) Education Fraud - A player is guilty of education fraud if they intentionally give the answers of a test from an Alexandrian university, ministry, or other government entity to someone else, or if they use answers illegally given to them under this provision.

(3) Attorney-Client Privilege Breach - A legal practitioner is guilty of breaching attorney-client privilege if they disclose attorney-client communications without the written permission of their client.

(4) Obstruction of Justice - A player is guilty of obstruction of justice if they willfully and deliberately act in a manner which hinders the apprehension, conviction, defense, or punishment of any player.

10 - Offenses Against the State and Public Order
(1) Treason - A player is guilty of treason if they levy war against Alexandria, or give aid or comfort to its enemies.

(c) Maximum Penalty: 200 Penalty Units fine + 240 minutes in jail
(2) Corruption - A player is guilty of corruption if they use any type of public office to gain an undue personal or political benefit.

(3) Bribery - A player is guilty of bribery if they persuade a public official to commit an illegal or immoral act in exchange for a benefit, or accept such a benefit to do so.

(4) Electoral Fraud - A player is guilty of electoral fraud if they intentionally and illegally alter the outcome of any Alexandrian election as prescribed by law.

(5) Electoral Bribery - A player is guilty of electoral bribery if they offer, give, or agree to give money, goods, services, or any other benefit of value to another player in exchange for that player casting their vote in a particular way, or in exchange for that player abstaining from voting.

(6) Leaking Classified Information - A player is guilty of leaking classified information if, while employed by a government body or while otherwise lawfully possessing classified materials, they intentionally release any information classified under the Freedom of Information Act to a player who does not possess the authority to view that information.

(7) Government Impersonation - A player is guilty of government impersonation if they present themselves as a player employed by the government of Alexandria when they are not.

(10) Peace Officer Misconduct - A peace officer is guilty of peace officer misconduct if they intentionally or recklessly engage in unlawful conduct in the exercise of their official duties.

(11) Harassment of a Polling Place - A player is guilty of harassment of a polling place if they intimidate, threaten, obstruct, or harass a voter, election official, or poll worker, and by that conduct interfere with or attempt to interfere with that person's ability to freely participate in a lawful election, while at or within a reasonable distance of a polling location.

(12) Following a Manifestly Illegal Directive - A person acting in an official capacity is guilty of following a manifestly illegal directive if they knowingly carry out an instruction or directive that is plainly and unambiguously unlawful, in circumstances where any reasonable person in that position would have recognized it as such.

(13) Evading or Resisting Arrest - A player is guilty of evading or resisting arrest if they attempt to escape from a peace officer when that peace officer is at that moment attempting to legally arrest or detain them.

(18) Solicitation - A player is guilty of solicitation if they ask another player to commit an offense, intending they carry it out.

(19) Accomplice - A player is guilty of being an accomplice if they assist another player in the commission of an offense, before or during that offense.

(20) Accessory - A player is guilty of being an accessory if they, with knowledge of an offense, intentionally assist the offender either in committing it or in avoiding detection or punishment.

11 - Court and Parliamentary Offenses
(1) Legal Malpractice - A legal practitioner is guilty of legal malpractice if they engage in gross professional misconduct in the course of representing a client.

(b) Maximum Penalty: 150 Penalty Units fine + 30 minutes in jail
(2) Frivolous Court Case - A player is guilty of filing a frivolous court case if they bring a legal claim that they know, or reasonably should know, is unsupported by facts or any legitimate applications to the law of those facts.
(a) Offense Type: Court Offense
(b) Maximum Penalty: 10 Penalty Units fine + 20 minutes in jail
(3) Contempt of Court - A player is guilty of contempt of court if they act in such a way that a reasonable player would perceive their conduct to be disrespectful to a judicial officer, or if they willfully disobey a lawful court order.

(b) Maximum Penalty: 10 Penalty Units fine + 15 minutes in jail
(4) Contempt of Parliament - A player is guilty of contempt of Parliament if they fail to comply with any term of a lawfully issued Parliamentary subpoena, or otherwise violate the authority or dignity of Parliament.

(b) Maximum Penalty: 10 Penalty Units fine + 15 minutes in jail
12 - Transitional Measures
(1) A player charged with conduct occurring prior to the enactment of this Act may elect to invoke any defense, penalty provision, or procedural right available to them under the law in force at the time the conduct occurred or this Act.
(2) Where provisions of prior law and this Act are not in conflict, both shall be available to the player.
13 - Severability
(1) The provisions of this Act are severable. Should one part be declared unconstitutional or otherwise invalid, it shall not affect the parts which remain.
