Amend the
Political Party Act
To establish a fallback political party verification method in the event the Ministry of Internal Affairs does not comply with the established codified verification timeline.​

1 - About this Act

(1) This Act

(a) may be cited as the ‘Political Party Registration Validation Act'.

(b) may be numbered as P.B. 07-004.

(c) shall be enacted upon receiving royal assent.

(d) has been authored by the Hon. Leader of the Opposition BluePitchGmgCCU.

(e) has been co-sponsored by the Hon. Deputy Leader of the Opposition Doge Soap McKakashi.

2 – Amendments to A.P. 04-046 | Political Party Act

(1) The following section shall be inserted, after Section 3(3)(a) the following new paragraph and subsection:

"(b) If the Ministry of Internal Affairs does not administratively respond to an aspiring party registration submission, within the allotted time period described in Section 3(3), the aspiring party's registration shall be deemed automatically accepted and will be considered a political party.

(i) Notwithstanding subsection (b), the Prime Minister shall receive full personal authority to handle the administrative functions of party registration of political parties who were registered automatically."​

The Political Party Registration Validation Act

Parliament notes:
(1) A codified fallback process, in the event of MoIA inaction when aspiring political parties complete a registration filing, does not currently exist.

Based on this, Parliament decides:
(1) To enact a de jure approval, in the event that the seven-day approval/denial with cause process isn’t adhered to.

(2) In the absence of MoIA action, to empower the Prime Minister to unilaterally ratify an aspiring party’s registration documents after the seven-day initial filing period.

To fulfil this, Parliament projects the following expenses:
(1) None.

Further, Parliament projects the following administrative efforts:
(1) None.

To implement the above, Parliament passes:

Political Party Registration Validation Act, as set out in the parent post.

2 – Amendments to A.P. 04-046 | Political Party Act

(1) The following section shall be inserted, after Section 3(3)(a) the following new paragraph and subsection:

(b) If the Ministry of Internal Affairs does not administratively respond to an aspiring party registration submission, within the allotted time period described in Section 3(3), the aspiring party's registration shall be deemed provisionally approved, and such aspiring party may function as a fully approved political party until such time as the MoIA completes its formal approval process.

(i) Notwithstanding section (b), in the event that such a provisionally approved political party’s registration is deemed invalid during the five-day election candidate declaration period, such candidates shall have the balance of said declaration window to either align with a different political party’s slate, if they have not already submitted a slate of candidates, or make a declaration as an independent candidate for Parliament if they chose to do so.​
