Violation of Regulations Procedure​

Preamble: this policy outlines the procedure which ought to be used in circumstances where:

(a) A plot owner does not hold the requisite playtime prescribed by law;

(b) A plot does not meet the relevant plot standards prescribed by law, including by reference to the Zoning Regulation Policy.

(c) An non-eligible players lease a designated new player CBD plot

PART I - ‘Playtime’​

1 - Notice Procedure for Playtime Violations

(1) Property Inspectors shall identify plots where the plot owner does not have the requisite playtime, which is currently prescribed by law as four hours of in-game play time within the last thirty days.

(2) Property Inspectors should appropriately record a notice as follows:

(a) The Property Inspector must take a screenshot of relevant play time of the plot owner and/or any other applicable plot violations.​

(b) The Property Inspector must issue a notice in-game using /mod-eviction-notice <name> <plot> <reason>​

(c) The Property Inspector must publish two posts, as follows:​
​
(I) Within the StateCraft Discord ‘#Evictions’ thread , in accordance with the format outlined in the appendix B.​
(II) Within the StateCraft Forums ‘Eviction Reports’, in accordance with the format outlined in the appendix A.​


2 - Rectification Period for Playtime Violations

(1) Where the player lacks the requisite playtime, the player has 7 days (168 hours), to accrue the requisite playtime. If the requisite playtime is accrued, the player must inform the MOD this has occurred within the 7-day period.

(2) Players may request an extension of the relevant period via the forums.

(3) Any request for an extension of the relevant period is considered by the ministry, on a case-by-case basis. There is no presumed right to an extension.


3 - Expropriation for Playtime Violations

(1) The Ministry of Development may expropriate non-compliant properties where the notice relates to failing the requisite playtime requirement, after 7 days (168 hours) of the notice being issued, providing no extension request has been submitted.

(2) Property Inspectors should follow the following process:

(a) To evict a plot, perform /mod-setplotowner GovDevelop <plot name>.​
(b) Note that this action was performed through a post on the forum thread and on the ‘#Evictions’ thread on the StateCraft Discord.​


4 - Eviction Auction Procedure for Playtime Violations

(1) Ordinarily plots acquired via expropriation are to be auctioned, unless otherwise directed and/or authorised by the Minister.

(2) Property Inspectors may conduct auctions in accordance with the prescribed procedure.

(3) Property Inspectors must not bid in an auction they are conducting. If a Property Inspector wishes to bid on an evicted plot, they must request another inspector conduct the auction, who will then receive the entire commission from the sale.

(4) All auctions shall follow the prescribed procedure, as follows:

(a) A thread in #real-estate is to be created in accordance with the template in appendix F.​
(b) The starting bid shall be set to £1,000, with an increment of £100.​
(c) The end time must be 48 hours without any new bids.​
(d) Only once 48 hours have elapsed since the last bid, should the Property Inspector:​

(i) Once the auction has concluded, fine the highest bidder using /fine <name> <amount> <reason> with the reason being the plot name.​
(ii) Concluding, transfer the plot using /mod-setplotowner <name> <plot>.​
(ii) Take their appropriate commission from the sale, being 10% of the total sale price using /unfine <name> <amount> <Commission of [Plot name]>​

(5) If the highest bidder does not hold the appropriate funds, a fine of £100 shall be issued with reason “false bid”. The auction is then open for at least another 24h for new bids. Should another bid be placed, the auction continues until a period of 48 hours passes without new bids.

(6) All commentary on an auction thread should be limited. The MoD may, at its discretion, suspend players who disturb auctions from participating in MoD auctions for 7 days.



PART II - ‘Plot Standards’

5 - Notice Procedure for Plot Standards

(1) Property Inspectors shall identify plots where the plot and/or the plots owner fail to meet the ‘plot standards’, as follows:

(a) Lack of Development – Where the owner does not make an effort to develop the plot over a thirty-day period.​
(b) Non-Compliance – Failure to comply with any regulation applying to plot types or build regulations (including the Zoning Regulation prescribed by the MoD).​
(b) Plot Limit – Failure to comply with the plot limit prescribed by law.​

(2) Upon identification of the above, the Property Inspector shall provide notice to the property owner, as follows:

(a) The Property Inspector must take a screenshot of any applicable plot violations.​
(b) The Property Inspector must issue a notice in-game using /mod-eviction-notice <name> <plot> <reason>​
(c) Post within the StateCraft Discord ‘#Evictions’ thread, in accordance with the format outlined in appendix B;​
(d) Post within the StateCraft Forums ‘Eviction Reports’, in accordance with the format outlined appendix A.​


6 - Relevant Period for plot standards

(1) The player has 10 days (240 hours), to rectify the issue in relation to plot standard or provide a plan to the MoD to develop or sell the property.

(2) Plans to develop or sell property shall be reviewed by the chief inspector or MoD leadership team.

(3) Any plan shall include a timeframe for rectifying the issue, as well sufficiently outline the proposal for rectifying the defect.

(4) If the MoD considers a plan to be deficient, the MoD must inform the plot owner of the nature of the deficiency and request a further revised plan be submitted no later than 10 days (240 hours) from the providing the plot owner notice of the deficiency.

(5) Players may request an extension of the relevant period via the forums.

(6) Any request for an extension of the relevant period is considered by the ministry, on a case-by-case basis. There is no presumed right to an extension.


7 - Failure to rectify defects and/or submit a plan in respect of Plot Standards

(1) If no plan has been submitted, after the period of 14 days has elapsed (336 hours) the MoD shall expropriate the plot in accordance with law.

(2) If a deficient plan has been submitted, after a period of 10 days (240 hours) from the MoD providing sufficient notice of the deficiency, should the MoD not receive a revised plan, the MoD shall expropriate the plot in accordance with law.

(3) Following expropriation, the MoD shall conduct an auction in the same prescribed manner as an ‘Eviction Auction’ as outlined within Rule 4 of this policy.


PART III - ‘New Player CBD Plot Process’​

8 - New Player CBD Plot Eligibility

(1) Designated new player CBD plots may only be rented by players who have a join date of less than 2 months prior to leasing the plot, in accordance with the MoD zoning regulations.

9 - Non-eligible tenants procedure

(1) Where a non-eligible player leases a designated new player CBD plot, they shall be fined £100 per day, continuing until they cease leasing the plot.

(2) Prior to issuing a fine, a Property Inspector shall issue a notice in-game using /mod-eviction-notice <name> <plot> [Non-eligible tenant under zoning regulations] to the tenant advising they have 48 hours to vacate the premises. If they:

(a) fail to vacate the plot; or​
(b) commence a new lease within that period;​

the property inspector shall commence fining the tenant.​

10 - Ministerial Discretion

(1) Notwithstanding preceding sections of Part III, The MoD retains the discretion to waive fines where it appears the tenant has acted in good faith and the non-compliance was inadvertent.
