Amend the Constitution to allow Parliament to establish activity requirements for voting and holding office​

1 - About this Act
(1) This Act:
(a) may be cited as the "Activity Requirements Enabling Act".​
(b) is numbered P.B. 04-006 (to be assigned by the Office of the Speaker).​
(c) shall be enacted upon passing a Constitutional amendment referendum.​
(d) has been authored by MP Capt11543.​
(e) has been co-sponsored by MP SoggehToast.​

2 - Amendments to the Constitution
(1) Article 22(1) of the Constitution shall now read:

"Every citizen has the right to run for and hold elected offices. Parliament may by law establish reasonable activity requirements for running in elections and maintaining elected offices."

(2) Article 22(2) of the Constitution shall now read:

"Every citizen has the right to vote in elections and referendums. Parliament may by law establish reasonable activity requirements for achieving and maintaining eligibility to vote."

The Activity Requirements Enabling Act​

Parliament notes:
(1) Activity requirements on voter eligibility was recently struck by the Chancery in Ameslap v. Crown, Case 12 (Ch. 2025).
(2) Activity requirements for voter eligibility, as well as eligibility to run for and maintain office, are plainly in the national interest.
(3) Parliament may amend the Constitution to make these requirements Constitutional, thus overturning the Ameslap v. Crown ruling.

Based on this, Parliament decides:
(1) To amend the Constitution to permit Parliament to establish activity requirements for voting and holding office.

To fulfill this, Parliament projects the following expenses:
(1) To be determined by future implementing legislation.

Furthermore, Parliament projects the following administrative efforts:
(1) To be determined by future implementing legislation.
