1 - About this Act
(1) This Act
(a) may be cited as the Statute of Limitations Terminology Modification Act.
(b) may be numbered as P.B.04-021.
(c) shall be enacted immediately upon its own assent and the assent of the Criminal Code Act and the Criminal Procedures Act.
(d) has been authored by Minister of Justice SoggehToast.
(e) has been co-sponsored by Capt11543.
2 - Amendments to the Statute of Limitations Act
(1) §4 - Limitations Placed on Prosecution shall be amended in the following manner:
“4 - Limitations Placed on Prosecution
(1) A peace officer shall be allowed to pursue criminal charges for all misdemeanor crimes Summary Offenses for thirty days after the initial overt act pursued in the commission of that crime.
(2) A peace officer shall be allowed to pursue criminal charges for all Felony crimes Indictable Offenses for sixty days after the initial overt act pursued in the commission of that crime.”
(2) §7 - Criminal Records and Expungements shall be amended in the following manner:
“7 - Criminal Records and Expungements
(1) All criminal records are publicly available at request to the Ministry of Justice.
(2) All criminal records shall be expunged and unable to be considered for purposes of legal discrimination, enhancements, or any other such legal determination after:
(a) Fourteen days after an individual is convicted of a misdemeanor Summary Offense; and
(b) One month after an individual is convicted of an Felony Indictable Offense."
3 - Transitional Measures
(1) For any crime committed prior to the enactment of this Act, the statute of limitations in effect at the time of the offense shall apply.
(2) For any crime committed after the enactment of this Act, the statute of limitations set forth in §4 of the Statute of Limitations Act shall apply.
(3) Any reference to "misdemeanor" and "felony" offenses elsewhere in the law shall be understood to refer to "summary" offenses and "indictable" offenses, respectively.
