To
Clarify Powers around Foreign Commerce
1 - Short Title and Enactment
(1) This Act
(a) may be cited as ‘Foreign Commerce Foundation Act’.
(b) may be numbered as P.B.04-022.
(c) shall be enacted upon being publicly assented to.
(d) has been authored by Minister of Foreign Affairs, PhillinDeBlanc.
(e) has been co-sponsored by Minister of Welfare, JustLegendMilk.
2 - Amendments to the Revenue Act
§13 of the Revenue Act shall be struck.
3 - Amendments to the RBA Replacement Act
§5 of the RBA Replacement Act shall be amended as follows:
"[...]
(b) To advise the Minister of Foreign Affairs in setting establish and set a foreign exchange rate to DC dollars,
[...]
(e) To dutifully monitor international exchange in cooperation with the MoTF and MoFA of goods, services and currency. , and, if necessary, temporarily suspend international exchange in times when the market is actively being manipulated by bad actors."
4 - Customs Office
(1) The Customs Office is hereby established.
(2) The Customs Office shall be jointly administered and empowered by the Ministry of Trade and Finance and the Ministry of Foreign Affairs.
(3) The Customs Office shall employ "Customs Officers"
(a) Customs Officers shall have the power to charge duties on imported goods in accordance with §7 of this act.
5 - Tariff Powers
(1) The Minister of Trade and Finance is hereby granted the power to set tariffs on imported goods using the Statutory Instrument authorized in §8 at the advice of the Ministry of Foreign Affairs.
(2) The Minister of Foreign Affairs is hereby granted the power to enforce tariffs on imported goods at the port of entry.
6 - International Trade
(1) All imported goods shall enter the Kingdom of Alexandria through Ports of Entry designated by the Ministry of Foreign Affairs.
(2) The Ministry of Foreign Affairs is authorized to issue Statutory Instruments to regulate Ports of Entry.
7 - Tariffs
(1) Tariffs shall be charged at the port of entry.
(2) Tariffs must be a percentage.
(3) Tariffs will be charged based on the value of items according to the last Consumer Price Index (CPI).
(a) The CPI used to evaluate value must be no more than two (2) months old.
(b) Items of non-intrinsic value that do not appear in the last CPI such as unique books or art shall be fairly appraised and charged by a customs officer.
(4) If the last CPI was completed more than two (2) months ago, tariffs shall be charged by item amount, rounded up to the nearest whole item.
(a) This shall not apply to items of non-intrinsic value.
(5) Tariffs are paid by the importing player.
(a) Value tariffs are paid to the SCGovernment account.
(b) Item amount tariffs shall be transferred to custodianship of the Customs Office.
8 - Tariff Schedule
(1) The Ministry of Trade and Finance is authorized to issue Statutory Instruments defining a Tariff Schedule, which outlines tariffs against imports.
(2) The Ministry of Trade and Finance may enact tariffs against imports of specific items, categories of items as defined by the Ministry, and/or on all imports from a particular sovereign entity.
(3) Statutory Instruments issued under this section shall be subject to the Affirmative Procedure.
(4) The Ministry may not impose any tariff at a rate greater than 20% of the price paid for an import.
9 - Embargoes
(1) At the advice of the Minister of Foreign Affairs, the Minister of Trade and Finance may impose or lift an embargo on a foreign country, completely suspending trade and/or foreign exchange with them.
(a) This action may only be conducted if there is reason to believe the market is being manipulated by bad actors.
(2) Embargoes against a foreign country must be announced publicly by the Minister of Trade and Finance or the Minister of Foreign Affairs as soon as they are levied.
(a) Embargo announcements must state if they are for item trade, monetary foreign exchange, or both.
10 - Sanctions
(1) The Alexandrian Monetary Bureau is hereby granted the authority to levy or lift sanctions on individuals and private entities.
(a) Sanctions may only be used against bad actors suspected of manipulating the market or causing damage to Alexandria’s economic health.
(b) Sanctions shall wholly prevent an individual from conducting trade and/or forex with the Kingdom of Alexandria.
(2) Sanctions against an individual or entity must be announced publicly by the Alexandrian Monetary Bureau.
(a) Sanction announcements must state if they are for item trade, monetary foreign exchange, or both.
(b) The Alexandrian Monetary Bureau shall keep a publicly accessible list of sanctioned individuals or entities.
11 - Foreign Exchange
(1) The Ministry of Foreign Affairs is hereby authorized as the sole public entity in charge of setting the Government of Alexandria’s foreign exchange rates and conducting foreign exchange transactions on behalf of the Government of Alexandria.
(a) The Minister of Foreign Affairs shall not conduct foreign exchange more than 10% above or below the rate they set.
(2) The Ministry of Trade and Finance is hereby authorized to audit and conduct oversight on the Ministry of Foreign Affairs’ foreign exchange transactions.
12 - Severability
(1) The provisions of this act are severable. Should one part of it be declared unconstitutional, it shall not affect the parts which remain.
