Resolution to​

Secure the Supremacy of Parliament​

1 - Short Title​


This Resolution may be cited as the “Resolution on Parliamentary Supremacy.”
This Resolution is Sponsored by MP Thritystone and co-sponsored by Ibney

2 - Preamble​

WHEREAS the Constitution of the Kingdom of Alexandria vests legislative power exclusively in the Parliament (§1);
WHEREAS Parliament is entrusted with the authority to create, amend, and repeal laws (§3);
WHEREAS the Westminster tradition, upon which Alexandria’s parliamentary system is modeled, affirms that Parliament is supreme and cannot bind its successors;
WHEREAS questions have arisen concerning the enforceability of statutory obligations upon Parliament following repeal or amendment;
AND WHEREAS Parliament retains the democratic mandate to legislate in accordance with the will of the people and in observance of constitutional law;

3 - Declaration​

NOW THEREFORE, be it resolved by the Parliament of the Kingdom of Alexandria:
  1. Parliament affirms the doctrine of legislative supremacy, whereby no Parliament may bind its successors, and no law may irreversibly constrain the legislative authority of a future Parliament.
  2. Statutory duties imposed upon Parliament or the Crown under a prior Act cease to have effect upon repeal of that Act, and may not be enforced against Parliament following such repeal.
  3. Referenda authorized by statute are legally binding only while the enabling statute remains in force, unless the referendum is conducted to amend the Constitution in accordance with §23 of the Constitution.
  4. Parliament recognizes the importance of legal certainty and affirms that repeal or modification of laws during active referenda or pending petitions should be conducted with caution and transparency.
  5. This resolution is non-binding and shall not have the force of law, but shall serve as an expression of Parliament’s interpretation of its constitutional authority.
  6. Parliament acknowledges the constitutional role of the Chancery in interpreting and applying the law, and respectfully submits that the Chancery consider this resolution as evidence of Parliament’s understanding of its own legislative powers and constitutional boundaries.

4 - Enactment​

This Resolution shall take effect immediately upon its passage by a majority of Members of Parliament.
