I am not opposed to this order, so long as the dismissal is with prejudice. I assume that it will be, but I just want that for the record. If the dismissal is without prejudice, I would be opposed to such a ruling and would instead request time to negotiate with the Crown.

Your Honor, recognizing that this would represent a departure from established Court procedure which would require special leave from the Court, the Crown hereby requests permission to file a response to this response.

Your Honor,

The Crown does not oppose dismissal with prejudice. We believe it would amount to double jeopardy to pursue these charges against after a conviction has already been issued and vacated.

WRIT OF DISMISSAL

The Court hereby dismisses this case with prejudice. Restitution must be paid to the Defendant in the amount of £600 for the fine levied against her, plus 1 Penalty Unit for each minute spent in jail (£50 for 30 seconds), totalling £650.​
