Establish Eminent Domain Proceedings
(1) This Act may be cited as the 'Eminent Domain Act'
(2) This Act shall be enacted immediately upon its signage. The passage of this act shall in no way affect cases currently in proceedings.
(3) This Act has been authored by Ibney0.
2 - Reasons and Legislative Findings
(1) Much of the city's many plots are owned by individuals currently not developing them;
(2) Worse still, much of the cities plots lay dormant because individuals are not active; and
(3) No process outlines how eminent domain proceedings function.
3 - Definitions
(1) "Eminent domain" shall refer to the power of the government to take property for public use.
4 - Powers of the Minister of Development
(1) The Minister of Development shall have the power to initiate eminent domain proceedings against the owner of any property within the Kingdom of Alexandria
(2) The Minister of Development, using their power of eminent domain, may seize land for the development of the Kingdom as they sees necessary to further the aesthetic and developmental goals of the government in exchange for just compensation.
(3) The Ministry must negotiate in good faith with the seller, and must provide a reasonable purchasing price to the seller before a sale may be finalized.
(4) The seller is obligated to comply with the final price offered by the Ministry of Development.
5 - Rights of the Seller
(1) Should a seller believe the final price of the Ministry of Development is unreasonable, they may file a claim within the Magistrate Court.
(2) The Magistrate Court shall first determine if there is sufficient evidence presented by the Ministry of Development that the land was seized in furtherance of an aesthetic or developmental goal. The Ministry of Development may not seize land arbitrarily for no reason.
(3) The Magistrate Court shall determine whether the final price offered by the Ministry of Development was reasonable. If the price was objectively unreasonable, the sale price shall be overturned, and the Magistrate Court shall hold a hearing to determine a reasonable price for the property.
6 - Severability
(1) The provisions of this act are severable. Should one part of it be declared unconstitutional, it shall not affect the parts which remain.
