If the Court grants the further extension, the Defendant requests a firm production deadline and that discovery remain open for 24 hours afterward, allowing review and completion of factual responses under Court Rules II(6) and III(3).

Please also direct the Plaintiffs to identify any ordered materials that do not exist or cannot be produced, and confirm the revised discovery closing date.

Granted in part. Discovery will remain open for both parties for 24 hours following the Plaintiff’s deadline to comply with the Writ to Compel (#19). However, I do not think there is any sense in requiring the Plaintiff to make the Court aware of material that does not exist.

@PhillinDeBlanc if there is material covered in the Writ to Compel that exists but is not produced, please make the Court aware of such, in line with your Discovery obligations.
